Appendix 3207. Weight limits on certain streets.

  • (a)

    No person shall drive a commercial vehicle that either has a gross vehicle weight of eleven thousand (11,000) pounds or more, or has more than two (2) axles on the following portion of the streets listed below:

    (1)

    Driver Avenue between Argos Street and Chesebro Road.

    (2)

    Argos Street between Driver Avenue and Thousand Oaks Boulevard.

    (3)

    Thousand Oaks Boulevard between Argos Street and Kanan Road.

    (4)

    Palo Camado Canyon Road between Chesebro Road and Canwood Street.

    (b)

    The provisions of subsection (a) shall not apply to the following:

    (1)

    Persons making pickups or deliveries of goods, wares, and merchandise from or to any building or structure located on the portions of the streets listed in subsection (a) or on a street having access only from the portions of the streets listed in subsection (a), or delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure for which a building permit has previously been obtained, located upon the portions of the streets listed in subsection (a) or on a street having access only from the portions of the streets listed in subsection (a);

    (2)

    Persons who reside on and have their driveway access from a portion of a street listed in subsection (a) or who reside on a street having access only from the portions of a street listed in subsection (a) and who obtained a commercial vehicle permit as provided below:

    a.

    Issuance of commercial vehicle permit. Commercial vehicle permits shall be issued by the director of public works or his designated representative. Any person residing on and having their driveway access from a portion of a street listed in subsection (a) or residing on a street having access only from the portions of the streets listed in subsection (a), may obtain a commercial vehicle permit to drive such vehicle to and from his or her residence;

    b.

    Application. To obtain a commercial vehicle permit, each applicant shall furnish his or her name and address and the license number of the vehicle;

    c.

    Description of commercial permit-display. The commercial vehicle permit shall be issued in card form and shall include the identifying license number, the date of issuance, and the time period for which the permit is valid. Such permit shall be placed in the interior of the vehicle in such a manner as to be clearly visible to traffic enforcement officers;

    d.

    Duration and renewal. The commercial vehicle permit shall be valid for a one-year period. Upon expiration of a permit issued under this section, the applicant may apply for and be granted a new commercial vehicle permit if the applicant still qualifies under the conditions set forth in this section. In no event shall a resident hold more than two (2) permits at any time;

    e.

    Fees. The city council may, by resolution, establish, a fee for issuance of the commercial vehicle permit.

    (c)

    Violation of this section is hereby deemed to be an infraction and is punishable according to the provisions of section 1200(b) of this Code.
